FA cup kit (didn't we actually have a similar problem the last time we did this with that purple kit where we were suddenly reminded to wear it at the last possible opportunity or face a fine?).
What's next on the 'announced before having the proper permissions in place' tombola? We'll probably find Gold never declared a previous bankruptcy on the tenancy agreement for the OS and it's null and void.
Actually that wouldn't be too bad. Until we end up ground sharing with the Clapton Ultras.

Well I don't believe it's a third kit as such as it has a different crest and therefore couldn't be worn in the PL, so it wasn't described as that.

I don't believe they did, it was in the press that it would be worn in the FA Cup but I don't recall anything from the club, they called it a commemorative kit rather than a third kit. This piece from Hugh seems to suggest the club knew it couldn't be worn in competition and seems to confirm that the issue is the Union Jack flag, not the sponsor.
"Unconfirmed rumours suggest the Thames Ironworks original Union Jack badge with TIW FC written on it might adorn the third shirt.
If true, this means the shirt can not be used in competitive matches but could be used in friendlies with the speculation that West Ham could wear it when the Hammers meet Juventus on Sunday 7th August in the former Olympic Stadium."
